Health Guarantee

Overview

puppies.co.uk operates a Safety Deposit Scheme under which buyers receive a Health Guarantee as set out in this document. This guarantee is available exclusively to buyers who have completed a purchase through the puppies.co.uk Safety Deposit Scheme and applies to the specific puppy named in the associated purchase record.

This guarantee is issued by puppies.co.uk. Breeders listed on puppies.co.uk are independent third parties. The guarantee described in this document is provided by puppies.co.uk directly and does not affect any separate obligations the breeder may have under applicable law.

1. What This Guarantee Covers

puppies.co.uk will provide a full refund of the purchase price paid through the Safety Deposit Scheme, including any deposit fee charged by puppies.co.uk, if all of the following conditions are met:

•       The puppy dies within 8 weeks of the date the Safety Deposit Scheme funds are released to the breeder (the 'Guarantee Period').

•       The cause of death is confirmed by a veterinary report to be a critical illness or condition that was present or originated before the puppy entered the buyer's home.

•       The veterinary report is issued by a veterinary surgeon registered with the Royal College of Veterinary Surgeons (RCVS).

•       The report is submitted to puppies.co.uk within the Guarantee Period and no later than 14 days after the puppy's death.

2. Definition of Critical Illness

For the purposes of this guarantee, a 'critical illness' means a medical condition that, in the professional opinion of an RCVS-registered veterinary surgeon, directly caused the death of the puppy and was:

•       present at or prior to the time the puppy entered the buyer's home; and

•       of such severity that the puppy's death was a direct consequence of that condition.

A diagnosis of critical illness without subsequent death does not activate this guarantee. The guarantee is triggered by death, where that death is attributable to a qualifying pre-existing critical condition.

3. What Is Not Covered

This guarantee does not apply in the following circumstances:

•       The puppy's death is caused or materially contributed to by accident, injury, neglect, abuse, poisoning, or any act or omission by the buyer or any third party after the puppy entered the buyer's home.

•       The puppy's death is caused by an infectious or contagious disease contracted after the puppy entered the buyer's home, including but not limited to parvovirus, distemper, or kennel cough, unless a veterinary report confirms the condition was incubating prior to the puppy leaving the breeder.

•       The claim is made after the Guarantee Period has expired.

•       The veterinary report is not from an RCVS-registered veterinary surgeon.

•       The required documentation is not submitted within the timeframe set out in Section 1.

•       The puppy was not purchased through the puppies.co.uk Safety Deposit Scheme.

•       The buyer has not complied with the post-collection care requirements communicated at the time of purchase, including any vaccination, feeding, or handling guidance provided by the breeder.

•       The death results from an elective procedure or treatment chosen by the buyer.

4. How to Make a Claim

To make a claim under this guarantee, the buyer must:

•       Notify puppies.co.uk of the puppy's death by email to info@puppies.co.uk as soon as reasonably practicable and in any event within the Guarantee Period.

•       Submit a written veterinary report from an RCVS-registered veterinary surgeon confirming the cause of death and, where possible, the likely origin and timing of the condition.

•       Provide the original purchase confirmation and Safety Deposit Scheme reference number.

•       Provide photographic or documentary evidence as reasonably requested by puppies.co.uk to support the claim.

puppies.co.uk will assess the claim and respond within 14 business days of receiving all required documentation. Where a claim is approved, the refund will be processed within 10 business days of approval.

5. Refund Amount

Where a valid claim is approved, puppies.co.uk will refund:

•       the full purchase price of the puppy as paid through the Safety Deposit Scheme; and

•       any puppies.co.uk platform deposit fee charged to the buyer as part of the transaction.

The refund does not include veterinary fees, travel costs, insurance premiums, accessories, food, or any other costs incurred by the buyer in connection with the puppy. puppies.co.uk is not liable for consequential or indirect losses of any kind.

6. Fraudulent or Misleading Claims

puppies.co.uk takes fraudulent claims seriously. Any attempt to make a false or misleading claim, including the submission of inaccurate veterinary reports or misrepresentation of the circumstances of the puppy's death, may result in:

•       immediate rejection of the claim;

•       permanent suspension of the buyer's account;

•       referral to relevant authorities where fraud is suspected.

puppies.co.uk reserves the right to seek a second veterinary opinion at its own cost before approving any claim. If a second opinion materially contradicts the submitted report, puppies.co.uk may reject the claim and will provide written reasons.

7. Limitation of Liability

This guarantee is provided in addition to, and does not affect, any statutory rights the buyer may have under the Consumer Rights Act 2015 or other applicable UK consumer protection legislation.

To the fullest extent permitted by law, puppies.co.uk's total liability under this guarantee is limited to the refund amount described in Section 5. puppies.co.uk is not liable for any loss, distress, or damage beyond this amount.

Nothing in this guarantee excludes or limits liability for death or personal injury caused by negligence, fraud, or any other matter which cannot be excluded by law.

8. General

•       This guarantee is personal to the buyer named in the original purchase record and is not transferable.

•       This guarantee is governed by the laws of England and Wales. Any disputes arising under this guarantee shall be subject to the exclusive jurisdiction of the courts of England and Wales.

•       puppies.co.uk reserves the right to amend the terms of this guarantee for future transactions. The terms applicable to any purchase are those in force on the date the Safety Deposit Scheme funds are released.

•       If any provision of this guarantee is found to be unenforceable, the remaining provisions shall continue in full force and effect.
